In the early 1990’s, Mr. Campos was one of the very first prosecutors in the country to convict a priest and have him sentenced to prison for his offenses.

PENALTIES FOR A SEX CRIME CONVICTION

Under Arizona law, the crime of possession of child pornography carries a mandatory minimum prison term of 10 years for each picture that is possessed. Sentencing must be consecutive for every picture possessed. What this means is that a defendant faces a minimum of 100 years in prison if he or she is convicted of possessing just 10 pictures.

A defendant convicted of Sexual Conduct of a Minor faces life in prison if the alleged victim is under the age of 12. Additionally, a defendant may not be entitled to get out of jail on bond or bail if the charge is one of the following: Sex Conduct with a minor and the minor is under 15 years of age or Child Molestation and the minor is under 15 years of age.

WHAT TO DO IF POLICE CONTACT YOU

If the police contact you and wish to speak to you, please do not speak to the police. Contact Mr. Campos first. The police may be pleasant. The detective may seem to act like you are innocent and that the investigation is a formality. Do not believe the police officer or detective that contacts you. Most officers already have their minds made up that you are guilty. The police are seeking to obtain evidence against you. Your statements to the police are the most damaging piece of evidence against you. Immediately tell the police that you want your attorney.

The key words are that YOU WANT AN ATTORNEY. Say nothing else. In fact, your loved ones should also ask for an attorney. If your wife, husband, brother, sister, father or mother wish to help you, they must also keep silent. The police will obtain incriminating information from your family. Your family does not have to speak to the police without a lawyer.

If you receive a phone call from someone and that person wishes to discuss an allegation that you committed some sex act. Hang up the phone. Do not continue to talk to this person. The phone call is most likely being recorded by the police. The caller is likely calling from the police department. This call is referred to as a CONFRONTATIONAL PHONE CALL. The entire purpose of the call is to trick you into admitting guilt.

The caller may say that he or she is undergoing counseling and the counselor suggested that an apology may make the caller whole. The caller may say he or she contracted a disease or became pregnant. Again, hang up. The caller is lying and seeking to get you to make an admission. Later, the police will arrest you. The police will already have a recorded statement from you. If you speak to the police, the police will trick you into making statements that contradict what you said on the tape. You will be made to look like a liar.

If the police arrive at your home and wish to search your home, do not give consent. Politely tell the police you refuse and they must obtain a warrant. If the police already have a warrant, again, make sure you state that you are NOT CONSENTING TO THE SEARCH. Be polite and cooperate with the police who are executing the search warrant but do not say anything and do not agree to the search.

Call Robert J. Campos immediately. If the warrant later turns out to be illegal, the evidence may be suppressed and cannot be used against you. However, if you also gave the police consent and the warrant was illegal, the evidence can be used against you.
