Before a judge makes a decision, he will review a report called a “Disposition Report”. The Disposition Report is supposed to give the judge all the important facts about you and your case. The Disposition Report is supposed to be fair and balanced. However, in reality, this is never the case. This is not the case because the probation department writes this report. Remember, the probation department and your probation officer are the ones who are alleging that you violated your probation in the first place.

  • He may file a sentencing memorandum on your behalf detailing all the positive aspects of your life.
  • He may interview the probation department and the probation officers involved in your case.
  • He may obtain a copy of your file from the probation department.
  • He may contact the prosecutor assigned to your case and point out any inaccuracies in your Disposition Report.
